The precautionary principle (PP) has been left in India to the interpretation of the Judiciary, which raises questions about the true essence and its applicability vis-à-vis different contexts. In some recent judgments,(for e.g. Narmada Dam), the PP has been diluted or overruled in favour of the development, which has become a powerful tool for the developers and the government not to apply PP as an underlying principle in various development activities and conservation efforts. My comment is in connection with point no 2-3 of the guidance principle and how such an issue can be addressed in the guidance note.
